The Yoknapatawpha County Sheriff's Department obtained the court records for Nathaniel Nelson VS. Church & Dwight Co., Inc., owner of Trojan brand condoms.

The case was filed on January 15, 2003.

In summary, Mr. Nathaniel "Hunter" Nelson (plaintiff) sued Church & Dwight Co. (respondent) for punitive damages due to the improper labeling of latex condoms. Mr. Nelson alleged that, after donning a Trojan condom handed to him by his date, he suffered an allergic reaction causing him emotional suffering. Mr. Nelson established, by way of affidavit from his physician, his allergy to latex rubber of the type used in respondent's condoms. Mr. Nelson alleged that, because of the low light conditions and the lack of adequate glow-in-the-dark labeling, he was unable to determine that the condom contained natural rubber latex and that this alleged failure to adequately label the product constituted negligence on the part of the respondent.

In September 2003, case was dismissed as being without merit.

Investigation of YCSD Case # 001294-23E-2004 is active and ongoing as of this date.
